2026 Mid-Year Legislative and Regulatory Update

One hundred forty-one bills related to pharmacist scope of practice and reimbursement for pharmacist-provided patient care services have been introduced across 41 states so far in 2026. States have enacted 37 unique bills and issued 12 final rules affecting pharmacists’ scope of practice or payment for services. These bills include the adoption of standard of care framework for pharmacy practice in two states, adoption of broad prescriptive authority in 3 states, and expansion of payment opportunities in 6 states.

All of the legislative and regulatory successes in the first half of 2026 are a direct result of the leadership and advocacy of the state pharmacy associations and reflect their commitment to advancing the practice of pharmacy by ensuring that pharmacists are authorized and paid to provide valuable patient care services via provider status legislation.

While these legislative victories represent significant progress in expanding pharmacist scope of practice and securing payment for pharmacist-provided services, it’s important to recognize that this is only a fraction of the legislative work undertaken by state pharmacy associations. Beyond payment and scope and PBM reform, state pharmacy associations engage in a wide range of advocacy efforts to advance the profession and improve patient care. These efforts include tackling issues such as drug pricing transparency, patient access to medications, regulatory compliance, and broader public health initiatives. The work of state pharmacy associations is multifaceted, encompassing a comprehensive approach to enhancing pharmacy practice at all levels.
